Gary Serbin is a Partner at Koffsky Schwalb LLC. He is also a registered patent attorney and a licensed professional engineer. Gary specializes in intellectual property litigation, prosecution and counseling for a diverse range of clients. He draws upon his counseling, IP prosecution and litigation experience at his prior positions with major law firms and as an in-house patent counsel at Symbol Technologies, Inc. (later acquired by Motorola Solutions, and then by Zebra Technologies).

From 1996 to 2001, Gary served as Symbol’s patent engineer, and then as its in-house counsel, managing IP prosecution, litigation, and licensing strategies for the company’s scanning division.

Gary’s extensive hands-on litigation experience stems from working at such well known firms as Patterson, Belknap, Webb and Tyler LLP (2001-2003), Willkie, Farr & Gallagher LLP (2003-2008), Lovells (2008-2010) and then Hogan Lovells US LLP (2010-2016). During his many years in private practice, Gary has handled all aspects of intellectual property litigation in federal courts and before the International Trade Commission, including trials. As a partner at Hogan Lovells, Gary first-chaired a week-long jury trial and has also successfully argued appeals at the Federal Circuit and the 2nd Circuit.

Gary’s matters covered such diverse technology areas as semiconductors, computers, consumer electronics, wireless communications, medical and opto-mechanical devices, and the Internet. His clients have ranged from small privately held companies to Fortune 500 corporations, such as Google, Daimler/Mecedes-Benz USA, Disney/ESPN, Airbus, Motorola Solutions, and Philips Electronics.

With a Master’s degree in electrical engineering, Gary has also acquired extensive industry experience, having worked as a design engineer at Symbol Technologies from 1989 to 1996, and prior to that at Grumman Aerospace Corp. and Gull Avionics Corp.

Gary’s broad experience enables him to provide clients with practical, business-oriented legal advice regardless of the technology areas involved in the dispute.

Gary is a recipient of Sanctuary for Families’ 2016 Above & Beyond Pro Bono Achievement Award for leading a successful appeal at the U.S. Court of Appeals for the Second Circuit on behalf of a victim of gender-based violence.

First-chaired a jury trial, winning a verdict of willful patent infringement and a permanent injunction, which was affirmed on appeal.

Defended Mercedes-Benz USA in a patent infringement suit against a non-practicing entity. The case settled on terms favorable to the client.

Defended Motorola Solutions, Inc. in a case involving RFID technology. The case settled on terms favorable to the client.

Defended Tyco Integrated Security in a case involving surveillance monitoring technology. The case settled on terms favorable to client.

Successfully defended an LCD-monitor manufacturer in an ITC investigation involving video processing, transistor fabrication, and optics patents.

Defended a sports/entertainment company in a patent infringement suit involving Internet technology. The case settled on terms favorable to the client.
